Our Terms of Service govern your access to, and, the use of, services and websites provided by semilimes AG, Switzerland, (hereafter “semilimes”), including, but not limited to: apps, websites, and APIs, (collectively called “Services”). Our Privacy Policy explains how your data is stored and processed, whereas our Acceptable Usage Policy summaries your responsibilities by using our Services.
Prior to making use of our Services, you are required to consent to our Terms of Service, Privacy Policy, Cookie Policy, and Acceptable Usage Policy. If you are using the Services we provide for an organization, you are agreeing to these Terms on behalf of this organization. You accept the Terms of Service, Cookie Policy, Privacy Policy and Acceptable Usage Policy by registering an account on our Services, or by otherwise accessing or using our Services.
semilimes assists you in creating a User Account on semilimes with the help of the semilimes app. Your User Account information involves a unique ID for a natural or legal person (legal entity).
semilimes provides you with a User Profile. A User Profile is the place where you can store your data and select with whom and when to share which data. A User Profile must be owned and controlled by a natural person or a legal person which has the corresponding User Account.
A User Profile is always connected to a User Account. A User Profile will be deleted if it is no longer connected to a User Account. User Accounts that do not represent natural persons or legal entities will be deleted.
semilimes also provides you with messaging, call and videoconferencing services that allow you to interact and exchange data with other semilimes Users.
There are three ways which allow you to interact with our Services. These are: User Account, semilimes User, or semilimes Developer.
semilimes also provides access to apps or a web service, which allows you to access the contents of your User Profile, which includes your Contact List, and your Messages.
In case you have a User Account but you did not populate your User Profile with data, you can still send data to User Profiles connected to User Accounts other than your own. In this case, however, you will not be able to keep record of the data that you have sent.
As “semilimes User”, you may also be granted access to apps and web services by third parties. Such access will be governed by separate agreements with the respective third party app providers.
The free User Profile storage provided by semilimes is limited to 50 megabytes.
Users under the age of consent as determined by the laws of the country they are located in at the time of consent must have written permission from a parent or guardian to use the Services.
A “semilimes Developer” is provided with development instructions and development support via https://semilimes.net/dev/api/reference .
In the case that semilimes performs maintenance with an impact our Services, we will use reasonable efforts to inform Users in advance via the website www.semilimes.net.
In the event of a Services outage, we will make sure to inform you and do our best to restore access to the Services as quickly as possible.
Given the scope of what semilimes is trying to achieve and our support of semilimes Services, we are unable, except to the extent required by applicable law, to provide any kind of warranties or guarantees. Except to the compulsory requirements by applicable law, we decline any responsibility for losses, damages, or liabilities that you might experience, whether direct, indirect, consequential, expected or otherwise. semilimes cannot be held responsible for any loss or corruption of data you provide to the Services. In the event of a dispute or claim in relation to these Terms and Conditions, Cookie Policy, Acceptable Usage Policy and/or Privacy Policy, you agree that the exclusive court jurisdiction of the courts of Aarau (Canton of Aargau) will apply to this Agreement. However, we will still be entitled to injunctive or equitable relief in any court if we are facing immediate harm or damage due to your actions.
This Privacy Policy describes how semilimes handles your data when you use semilimes apps, websites and Services.
When you create a semilimes User Account, semilimes stores the following information about you in order to provide the Service:
- Your mobile phone number
- Data stored on your semilimes User Profile
- Data exchanged with other semilimes Users via semilimes Messenger
This information will solely be used to reset your password upon your request, or to contact you in case of crucial service announcements. Your mobile phone number needs to be working to be able to reset your password.
User can also request User's address book to be synchronized. For this operation, User’s address book data is transmitted to semilimes servers in one-way encrypted (“hashed”) format and additionally protected by means of TLS encryption. Our servers keep this hashed data only in volatile memory, and for a short period of time, so that the list of matching User IDs can be determined. Once this operation is performed, the hashes are immediately deleted. At no point in time are the hashes written to non-volatile storage.
Your password is also saved in a hashed form. The hashed password is saved so that your identity can be verified when logging in to your semilimes User Account.
Your data will not be shared outside of semilimes and legally contracted semilimes service providers. We do not use your data for targeted advertising.
semilimes will not provide access to your data for any other reason than providing it to those Users who have been granted access to it by the User Profile owner(s) or administrator(s).
semilimes may share the information collected from you with legally contracted technology services providers that partner with semilimes to support semilimes’ product, technology, and infrastructure needs. There may be circumstances where service providers’ responsibilities related to supporting production infrastructure require them to be exposed to user information.
You can access, modify, download, and delete your personal information on your User Profile by logging into your User Account via semilimes app and going to your account settings page. You can also limit the way we collect and use the data on the user control page of your account.
By signing up for a semilimes User Account, we will keep data that you store on our Services for as long as your User Account is in existence, or as long as we require it to deliver the Services to you. You can terminate semilimes Services at any time. If you delete your User Account, all data on your User Profile will be deleted, and there will be no opportunity to recover such data or account information.
We will give our best efforts to ensure that your data is secure. In case of a breach of your data, we will apply our best efforts to notify you as soon as we find out. If you have encountered or suspect any exposure of your data, or a technical vulnerability, please report it immediately to datadatasecurity@semilimes.com. You are solely responsible for choosing a personal identification number or providing biometrical indentification to keep your account safe.
semilimes may be required to disclose data and information as necessary to satisfy any applicable law, regulation, or legal process. semilimes will apply its best efforts to notify you about government requests or inquiries that involve your data.
Your semilimes User Profile data will be stored on our hosting providers’ servers. This is currently Amazon Web services https://aws.amazon.com, in Ireland.
We will notify you in advance on any change of our Terms of Service. We will not assume that you agree to new Terms of Service just because you agreed to our previous Terms of Service. You will be asked to agree to the new Terms of Service.
Your data may be transferred if semilimes is involved in a merger, acquisition, reorganization, or sale of our business or assets. We will promptly notify you via semilimes Messenger or via the website semilimes.com of any such event and outline your choices at that time.
We can be contacted on datadatasecurity@semilimes.com in case you have any requests regarding your rights. You can exercise full control over your personal data and how it is collected, used, and shared.
Among others, you have the right to request access to your personal data. This is called "data subject access request" and allows you to review your personal data that is stored by semilimes, and to confirm that we are processing your it in compliance with applicable laws.
You may also request us to correct incomplete or wrong personal data that we hold about you. Please note that we may nevertheless need to verify the accuracy of the new data you provide to us.
Your rights also include to:
- Request the deletion of your personal data if semilimes has no good reason for continuing processing it. You can also exercise your right to ask for deletion or removal of your personal data in case you have successfully exercised your right to object their processing, if we might have processed your data unlawfully, or if we are required by local law to erase your personal data. However, please note that we might not always be in the position to satisfy your request of deletion for legal reasons which, if applicable, will be notified to you at the time of your request.
- Contest the processing of your personal data if you are in a situation that impacts your fundamental rights and freedoms, even though we or third parties might have legitimate interests, with the exception that we have compelling legitimate grounds to continue processing your data, which override your rights and freedoms.

Request semilimes to restrict or suspend the processing of your personal
data if:
1. we unlawfully make use of your personal data, but you do not want us to
erase it;
2. you want us to establish the accuracy of your personal data;
3. you require us to hold your personal data even if we no longer require it as
you need it to establish, exercise or defend legal claims;
or,
4. you have contested our use of your personal data, but we need to verify if
we have overriding legitimate grounds to continue using it.
- Request the transfer of your personal data, in which case we will provide you with your personal data in a structured, commonly used, machine-readable format. At any point in time you can

- Violating the privacy of others or infringing their rights;
- Using the Services to violate any law or regulation.
- Interfering with or disrupting any user, host, or network, for example by sending a virus, trojan horses, any malicious software, overloading, flooding, spamming, or message-bombing any part of the Services;
- Breaching or otherwise circumventing any security or authentication measures;
- Sending unsolicited communications, promotions or advertisements, or spam;
- Promoting or advertising products or services other than your own without appropriate authorization;
- Sending altered, deceptive or false source-identifying information, including "spoofing" or "phishing";
- Abusing referrals or promotions to obtain more storage space than deserved;
- Circumventing storage space limits;
- Selling the Services on behalf of semilimes, unless specifically authorized to do so;
- Harassing or abusing semilimes personnel or representatives or agents performing Services on behalf of semilimes;
- Violating the law in any way, including storing, publishing or sharing material that's fraudulent, defamatory, or misleading;
At our sole discretion, semilimes reserves the right to delete and close User Accounts that do not comply with semilimes’ Terms of Service, Privacy Policy, or Acceptable Usage Policy.
semilimes reserves the right to limit a user’s activity or delete and close a user’s account if such user is monopolizing an unfair proportion of available system or network resources,

semilimes websites may contain links to websites that are not owned, operated or controlled by semilimes, and, therefore, semilimes is not responsible for the content or your use of such websites. All materials provided on the semilimes website, including but not limited to information, documents, products, logos, graphics, sounds, images, and Services, are the copyrighted work and intellectual property of semilimes.
When you are accessing the websites https://www.semilimes.com and https://dev.semilimes.net, semilimes collects the following data by means of cookies:
- User ID
- User IP Address
- Title of the page being viewed
- Time in local user’s time zone
- Date and time of the request
- URL of the page being viewed
- URL of the page that was viewed prior to the current page
- Screen resolution being used
- Files that were clicked and downloaded
- Links to an outside domain that were clicked
- Page generation time
- Location of the user
- Main language of the browser being used

The data collected from cookies is used to analyze which parts of the website are being viewed in which order and on which browsers, as well as the usage per country and time of day.

semilimes may share the browsing data collected with legally contracted service providers, who support semilimes. They are bound by the same terms as semilimes is bound to you.
